These are the official Terms and Conditions of Use (the “Terms”) for Savannah Robertson Wellness dba Embody Her Now, located in Schuyler, Nebraska (“Company,” “we,” “our,” or “us”).

1. INTRODUCTION & GENERAL PROVISIONS

This Site is owned and operated by Savannah Robertson Wellness dba Embody Her Now.

By accessing or using the Site and/or any Offerings, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please discontinue use of the Site and do not purchase or access our Offerings.

We reserve the right to update, change, or replace any part of these Terms at any time by posting updates on this page. The “Last Updated” date above reflects the most recent changes. Your continued use of the Site or our Offerings after any changes are posted constitutes your acceptance of those changes.

3. TERMS OF SITE & PURCHASER AGREEMENT

All Offerings are owned and provided by Savannah Robertson Wellness dba Embody Her Now.

These Terms govern how you may use and access our Site and Offerings, including but not limited to:

Online courses

Group programs and memberships

1:1 coaching and sessions

Somatic bodywork sessions

Events (in-person and virtual)

Digital products, replays, meditations, and other content.

You are legally bound by these Terms whether or not you have read them in full.

If you do not agree with any part of these Terms, please email us at [email protected] and we will make reasonable efforts to remove your email and revoke your access where applicable, subject to our refund, payment, and termination policies.

4. INTELLECTUAL PROPERTY RIGHTS & LIMITED LICENSE

4.1 Our Intellectual Property

All images, text, designs, graphics, logos, trademarks, service marks, trade names, audio, video, course materials, handouts, workbooks, worksheets, meditations, slides, and other content (“Content”) are owned by or licensed to Savannah Robertson Wellness dba Embody Her Now, unless otherwise stated.

This Content is protected under copyright, trademark, trade secret, and other intellectual property laws. Copying, distributing, sharing logins, reselling, or uploading our Content or Offerings to file sharing sites without permission is strictly prohibited and may be prosecuted to the fullest extent permitted by law.

You agree not to:

Copy, reproduce, distribute, re-publish, or publicly display any Content without our express written permission;

Claim ownership over any of our Content or Offerings;

Use any of our trademarks, logos, or branding without our consent;

Share, sell, or trade your login information or access to any Offering;

Upload our Package/Course files or materials to any sharing platform;

Use our Offerings or Content in an unlawful way or for any illegal purpose.

4.2 Limited License to You

Subject to your compliance with these Terms and full payment (where applicable), we grant you a limited, non-transferable, non-exclusive, revocable license to access and use the Offerings for your personal, non-commercial use only.

You may:

Access the Offering for your personal use;

Download and/or print Offering materials for your own personal use in your life or business.

You may not:

Re-sell, share, or redistribute any Offering or materials to others;

Claim any of our materials as your own;

Reproduce or modify any part of the Offering and present it as your own product, program, or service.

If you exceed the scope of this license, you may be considered infringing our rights and we reserve the right to seek damages, injunctive relief, and any other remedies available under law.

5. USER CONTENT, CONTRIBUTIONS & MODEL RELEASE

5.1 User Content & Contributions

You may be able to post, upload, or submit content (“User Content”) on or through the Site and/or related platforms, including but not limited to:

Reviews and testimonials

Comments on social media or inside community spaces

Posts in Facebook groups, membership hubs, or course platforms

Emails or messages sent to us that share experiences or feedback.

By posting or submitting any User Content, you:

Represent and warrant that you are the owner of the content or have permission to submit it,

Represent that your content does not infringe the rights of any third party, and

Grant Savannah Robertson Wellness dba Embody Her Now a perpetual, worldwide, nonexclusive, royalty-free, assignable, and sublicensable license to use, reproduce, modify, translate, adapt, publish, display, distribute, and create derivative works from such content in any media now known or developed in the future, including for marketing and promotional purposes.

We may monitor, moderate, remove, or refuse any User Content at our sole discretion. You are solely responsible for the content you post and any consequences arising from it.

You agree that your User Content:

Will not violate any third-party rights (e.g., copyright, trademark, privacy, publicity);

Will not contain libelous, abusive, obscene, or otherwise unlawful material;

Will not contain viruses, malware, or harmful code;

Will not be misleading, deceptive, or fraudulent.

We assume no liability for any User Content posted by you or any third party.

5.2 Events, Calls, Recordings & Likeness

By participating in any of our events, programs, or sessions—whether in person, via Zoom, or through any other digital platform—you consent to being photographed, filmed, or recorded.

You grant Savannah Robertson Wellness dba Embody Her Now the unrestricted right to:

Use, reproduce, display, distribute, publish, and create derivative works from your likeness, image, voice, name, and any written, verbal, or visual contributions in any media format, including but not limited to: websites, social media, course platforms, promotional materials, and advertising, without further permission or compensation.

This includes screenshots, testimonials, comments, or interactions shared during:

Live or recorded Zoom calls,

Group forums and community spaces,

Membership hubs, and

In-person gatherings and events.

We are not obligated to notify you each time your image or contributions are used.

If you do not want a specific contribution (e.g., a particular comment or post) shared, you must explicitly state this at the time of submission.

6. USER RESPONSIBILITIES & SECURITY

You agree that you will:

Keep your username and password confidential and not share them with any other person;

Not use another user’s login or registration information;

Not create fake accounts for spamming, data collection, or deceptive practices;

Not circumvent, disable, or interfere with security-related features of the Site or our platforms;

Provide accurate, truthful, and complete information where required (e.g., account registration, checkout).

You are responsible for securing your login credentials. We are not responsible for any unauthorized access or use of your account due to your failure to safeguard this information.

7. COMMUNICATIONS & PRIVACY

Any communications made through our contact forms, email, social media, or other channels are not necessarily privileged or confidential unless explicitly stated (e.g., via a separate written agreement or where mandated by law).

We may store, use, or republish communications (e.g., emails, messages, comments) in part or in whole as reasonably required in the course of our business and in line with our Privacy Policy.

8. PURCHASES, PAYMENTS & PRICING

8.1 Payment Terms

You are responsible for paying for any Package, Course, program, membership, event ticket, or other Offering in full and for providing a valid payment method.

By entering your payment information at checkout, you:

Authorize us (and/or our third-party payment processors such as Stripe, PayPal, or other platforms) to charge your payment method for the total amount displayed;

Agree to abide by the terms and conditions of your card issuer and any third-party processor;

Agree to provide current, complete, and accurate payment details and to promptly update them if they change.

If your payment is declined, returned, or deemed fraudulent, your access to the Offering may be suspended or terminated until all payments are made in full.

If you enrolled through a payment plan, missed or late payments may result in suspension or termination of access unless and until remaining payments are made in full.

We reserve the right to change our prices at any time for new purchases.

8.2 Recurring Payments & Renewals

If you purchase or sign up for an Offering that automatically renews or recurs (e.g., monthly membership, payment plan), you authorize us to charge your payment method for all recurring charges until you cancel in accordance with our policies.

You may cancel a recurring Offering by contacting us at [email protected]. Cancellation does not excuse you from paying any outstanding balances already owed, including the remainder of a payment plan if applicable, unless otherwise stated in writing.

8.3 Currency & Taxes

Unless otherwise specified at checkout, all payments are processed in U.S. Dollars (USD).

Applicable sales taxes will be added to your order as required by law in either your or our local jurisdiction.

8.4 Errors & Order Cancellations

We reserve the right to correct any errors or mistakes in pricing or product details, even if payment has already been received. If a correction affects your order, we will notify you by email and provide options, which may include cancellation and refund where appropriate.

We reserve the right to refuse, limit, or cancel any order, including orders that appear to be placed by resellers, dealers, distributors, or wholesalers, or in any attempt to resell our Offerings. We may limit quantities, cancel duplicate orders, or restrict orders based on account details (such as payment method, billing address, or shipping address).

9. REFUNDS, RETURNS & CHARGEBACKS

9.1 Refund Policy

Unless otherwise stated in writing for a specific Offering, all sales are final and non-refundable. Due to the nature of digital products, services, and energetic/educational experiences, returns and refunds are generally not accepted.

If an Offering specifies a different refund policy, that specific policy will apply only to that Offering.

9.2 Chargebacks

Opening a chargeback or payment dispute after legitimately purchasing an Offering may be considered payment fraud.

If a chargeback is initiated:

You may lose access to all courses, Offerings, and platforms purchased;

Your account may be locked, and you may be blocked from purchasing future Offerings;

You may be held responsible for any administrative and legal fees incurred in obtaining payment.

You agree to contact us first and make a good-faith effort to resolve the situation before filing any chargeback or dispute.

We reserve the right to provide proof of your purchase, access logs, and these Terms to your financial institution during the dispute process.

10. NO RESELLING OR UNAUTHORIZED DISTRIBUTION

We expressly prohibit:

Orders intended to resell or redistribute our Offerings;

Uploading course materials, files, or content to any file-sharing or pirated-content site;

Sharing login credentials to circumvent payment.

We reserve all rights to revoke access and seek legal remedies for unauthorized distribution or reselling of our Offerings.

11. ASSUMPTION OF RISK, DISCLAIMERS & NO PROFESSIONAL ADVICE

11.1 General Disclaimer

Our Site, Offerings, and all related materials are provided on an “AS IS” and “AS AVAILABLE” basis, without any warranties or guarantees of any kind, whether express or implied.

You understand and agree that:

We make no guarantees as to any specific results (emotional, physical, financial, relational, spiritual, or otherwise) from your participation;

11.4 Technology Disclaimer

15. CONFIDENTIALITY

15.1 Your Confidentiality

Except where explicitly stated (for example, in a separate coaching agreement or where mandated by law), you should not assume a right to confidentiality for communications through the Site or general Offerings.

Group containers, group calls, and community spaces are not confidential therapy or legal environments. You are responsible for your own disclosures in group settings.

15.2 Our Confidential Information

You agree to keep in strict confidence any confidential, sensitive, or proprietary information of Embody Her Now that you may receive, whether or not such information is marked “confidential” or “proprietary.”

You agree not to:

Disclose our confidential information to any third party;

Use our confidential information for any purpose other than as necessary in connection with the purchased program or service.

You agree to maintain appropriate physical, electronic, and procedural safeguards designed to protect our confidential information from unauthorized access or disclosure.

16. TERMINATION & REVOCATION OF ACCESS

We reserve the right, in our sole discretion, to:

Terminate, suspend, or restrict your access to the Site or any Offerings, with or without notice, for any lawful reason;

Revoke access if we believe you have violated these Terms or any additional agreements.

By way of example (without limitation), termination may occur if:

You fail to make timely and complete payments under any agreed payment plan;

You are abusive, rude, aggressive, or threatening (in writing, verbally, or physically) toward anyone within Embody Her Now or associated with the Savannah Robertson brand;

You harass, insult, harm, defame, slander, disparage, or discriminate against anyone within Embody Her Now or associated with the Savannah Robertson brand, including on social media;

You breach these Terms or any additional agreement with us.

If an agreement or access is terminated for cause:

We shall have no further obligations to you;

There will be no reimbursement of payments already made;

In the event of an outstanding payment plan, you may remain liable for the full remaining balance.

If you choose to terminate your own access or use of the Offerings, you remain responsible for any outstanding balances owed, unless a separate written policy states otherwise.

17. NON-DISPARAGEMENT

You agree not to make statements or engage in conduct that defames, disparages, or harms the reputation of Savannah Robertson Wellness dba Embody Her Now, our Offerings, or anyone associated with our brand.

If you are found to be slandering, libeling, or otherwise disparaging us (in our sole discretion), we reserve the right to:

Immediately remove your access to our Offerings and related communications;

Pursue appropriate legal remedies if your conduct materially harms the Company.

18. DISPUTE RESOLUTION, CHOICE OF LAW & WAIVERS

18.1 Choice of Law

These Terms and any disputes arising out of or related to your use of the Site or Offerings are governed by and construed in accordance with the laws of the State of Nebraska, without regard to conflict of law principles.

You agree that the state and federal courts located in Nebraska shall have personal jurisdiction over any matter arising from or relating to these Terms, subject to the arbitration provisions below.

18.2 Informal Resolution

We believe in resolving issues as efficiently and amicably as possible. If a dispute arises, you agree to first contact us at [email protected] and make a good-faith attempt to resolve the matter informally.

18.3 Arbitration

If informal resolution is unsuccessful, you agree that any claim, dispute, or controversy arising out of or relating to these Terms, the Site, or any Offerings shall be submitted to binding arbitration.

The arbitration will be conducted in or near Nebraska, unless otherwise mutually agreed;

The arbitration shall be conducted by a single neutral arbitrator, in accordance with applicable arbitration rules;

Each party shall bear its own costs and attorneys’ fees, unless the arbitrator awards otherwise as permitted by law.

18.4 Waiver of Jury Trial & Class Action

By agreeing to these Terms:

You waive any right to a jury trial in any and all judicial proceedings related to disputes arising from your use of the Site or Offerings;

All parties waive the right to participate in any class action, class arbitration, or other representative proceeding. Any claims must be brought on an individual basis.

19. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.

20. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any additional written agreements specific to a particular Offering, constitute the entire agreement between you and Savannah Robertson Wellness dba Embody Her Now with respect to your use of the Site and Offerings.

All other prior or contemporaneous agreements, proposals, or communications (whether oral or written) are superseded by these Terms.

21. CHANGES TO THESE TERMS
